My wife's car was hit by another vehicle who ran a stop sign two days ago. Police cited the driver for two tickets, failure to stop and failure to yield. We have contacted their insurance company in order to have my wife's vehicle repaired and to obtain a rental vehicle. The insurance company will not approve any funds until the other driver contacts them admitting that they were at fault. Is there a law requiring an insurance company to approve funds within a certain period of time? If it is state, county or city specific, we reside in Buffalo which is in Erie County NY. I've had several accidents over the years, 2 major last year. Neither were my fault. Anyways, it seems no matter what company I use, I start off reasonable then all of a sudden a few months later they "find" the accidents and my rates skyrocket. I'm currently up for renewal, and I owe 700 and something at the end the month to stay with them, and then like 300 in something every month. I know I don't have the greatest history and stuff, but there's got to be cheaper. Right now I'm using Progressive. In the past I've used Geico, but have gotten estimates elsewhere too.... Any other suggestions??? I work a minimum wage job. I can't afford this..... Similarly, if the other driver is at fault (liable), then her insurance company covers her for that and reimburses me. When you have collision coverage, then your insurance company will reimburse you and then go after the other insurance company themselves. Here, because i only have liability coverage, i have to go after them myself. Fred- just some basic knowledge about insurance... Zestorer- so far you have the only answer with substance. Anyone else? So, fred what exactly are you confused about? I am a student, my wife was at one time unemployed, i asked about a wife leaving a country for a friend of mine who had no internet access, and, thank g-d, i have kids. What now? To all, wouldn't the fact that the police report of the accident does not contain any information about the vehicle (such as a description of it that i may have seen or that she may have seen) or that there is no other police report showing that they are investigating this accident as a hit and run, considering that in NY this is a serious crime. This is a confusing situation. My husband in deployed and I live in NY. I just traded in one of our cars and since I didn't have my husbands drivers license with me they only put my name on the title. On one of the other cars we have we bought it during his last deployment and its title is only in my husbands name. I'm originally from CA and things are very different car-wise in NY so I'm completely unsure of how to go about adding both of our names to each title and registration. Another thing is that since my name isn't on my husbands title or registration for one of the cars it doesn't show my name on the insurance card. I got a moving violation for "improper passing" in New Jersey which will give you 4 points. I have a few questions thought 1) Do you automatically get points for this or is it only for repeated violations? 2) I have a NY License and was ticketed in NJ, but i don't own a car and am not insured (i was driving my boyfriends car) if i do get points is it something i should really worry about being that i don't have insurance? 3) I gave the cop a hard time because i didn't believe the ticket was warranted; now i am worried he will show up to make sure i don't get a lesser offense should i bother going to to court date? (i know it was pretty stupid of me to do so but i believe he ticketed me improperly). Any advice would be greatly appreciated!

My licence was suspended when I drove my car that was in storage without insurance, in Ohio. I moved to New York on April 12th and the license went into suspension on April 24th and if I pay the reinstatement fee, until July 25th. It says that I have to pay the reinstatement fee, get SR22, and serve the 3 month suspension. The problem is that NY does not have SR 22 bonds and I cant get one in Ohio because I do not live there. What can I do? The other thing is that I saw in the paper they sent me that you can get a limited license through the municiple court where you live. That is out because I do not live in Ohio. Voting Question: Are there any loop holes in NYS DMV laws that I can use to get the suspension on my license lifted?

I purchased my first car last year and asked the dealer if the car came with Anti Lock Breaks (ABS). The dealer said it did, as well, the NY State inspection report had Anti lock breaks checked off on it as one of the features. I had been reading through the manual and noticed that when the car comes on it should flash with ABS on the dash display when the car starts but it never has done so. I had the car checked out by the dealers mechanics one day on a normal service visit and they found that there was no ABS insttalled and apparantly it cannot be installed because it is something that must be put in during the time of manufacturing. Having no ABS would increase my insurance rate. Also, if I had been in an accident with no ABS what would happen? I called the dealer and they said there was nothing they could do. I have been reluctant to go to legal councelling as it would cost about $200 USD just to sit down with a consumer law lawyer and discuss it. Can anything be done?

I recently moved out of Massachusetts and just put my car on the road in another state. I spoke with my insurance carrier who said I needed to return the plates in person to the DMV and since this was not a possibility, said that I could just destroy the plates or keep them, and I did not have to worry about returning them to the DMV.
I just want to make sure this is actually true, as when I moved out of New York State I failed to return my plates and as a result had my license suspended for over two years (the time it took between when I took my car off the road in NY and returned the plates). I did find an address where plates can be mailed but my insurance carrier told me not to mail them because they often get lost in the mail.
